Are competitors stealing your online customers?

Hogan Lovells' London Brands Team is going to be discussing this issue and talking about ways to tackle it at their annual trade marks seminar in their London office.

UK Internet shoppers spend over £60 billion annually. Companies are hungry for a bigger piece of the online pie and are going to great lengths to drive traffic to their websites.

One tactic involves buying a competitor's brand name as a search engine keyword, so that a search for that term produces a sponsored link or ad on which customers can click. But whose customers are they?

Is this type of trading acceptable from an IP perspective, and if not, what can you do about it? Various European Courts have looked at this matter a number of times, but uncertainty remains.

The Brands Team is going to talk through some important recent decisions, on this and other issues, try to give a steer as to where the law is heading on the issue, and explain what brand owners can do to protect themselves.
