Automotive clients call on Colm Moran for his industry knowledge and confidence in litigation matters. Colm handles motor vehicle franchise law and class action defense.

Co-chair of the firm's automotive litigation practice, Colm helps clients all around the United States. Motor vehicle manufacturers rely on his counsel regarding state motor vehicle franchise laws in all 50 states. Colm has handled litigation for such manufacturers in more than 25 jurisdictions.

Colm's has represented a wide array of motor vehicle manufacturers in litigation and counseling involving letters of intent, franchise terminations, warranty and incentive fraud, the implementation of new standard forms of dealer agreements, add-points, relocations, allocation issues, post-termination matters, and the interpretation of state franchise statutes. Colm has also represented automobile manufacturers in actions involving Racketeer Influenced and Corrupt Organizations (RICO) allegations arising from dealership fraud, and has defended putative class actions filed against motor vehicle manufacturers.

Colm has also handled general commercial litigation and arbitration in California and throughout the United States.

Won summary judgment in favor of motor vehicle manufacturer in case where former dealer alleged that a release agreement was an unenforceable waiver.

Won an appeal of an order denying summary judgment in Georgia where consumers sought to hold a manufacturer responsible for dealer misconduct.

Won denial of dealer's motion for a preliminary injunction in federal court preventing its termination.

Won summary judgment terminating dealer based on dealer's breach of obligation to establish exclusive showroom.
