"U.S. Department of Education Proposes Rule on Program Integrity For Public Comment." Education Investors Alert, Hogan Lovells, 22 June 2010

On 18 June 2010 the United States Department of Education (ED) released for public comment a Notice of Proposed Rulemaking (NPRM) that addressed important matters for postsecondary education institutions that participate in federal student financial aid programs under Title IV of the Higher Education Act (HEA). 75 Fed. Reg. 34,806. Covered matters included state authorization, incentive compensation, misrepresentation, and definition of credit hours. ED deferred a substantive measure of "gainful employment," but it proposed related reporting and disclosure requirements.
