Ruud van der Velden has over 15 years experience in multi-jurisdictional patent and trade secret litigation. He litigates before all Courts in the Netherlands and the EPO. He represents companies in all technological fields, with a particular focus on the high tech and life sciences industries.

Ruud has an excellent track record in complicated cases. Examples include obtaining a cross-border patent infringement injunction at a time this was considered impossible, successfully enforcing a second medical use patent that was revoked in almost every other jurisdiction, and seizing evidence in a logistical warehouse in the Netherlands in absence of a patent in force in the Netherlands, which evidence was pivotal in securing injunctions in Germany. The latter is a good example of how Ruud works together with his patent litigation colleagues in other countries in order to develop an overall winning strategy. 

Besides litigation, Ruud also works with clients on their patent and trade secret protection strategies, in order to improve their success in the market and, if necessary, in court. He regularly lectures and publishes on patent and trade secret topics. He has received the Dutch AIPPI award for his publication on obtaining evidence of patent infringement.

Representing Nikon in over twenty patent infringement proceedings against ASML and Zeiss relating to lithography and camera technology, which led to a settlement between the parties

Obtaining an injunction for Merck in patent infringement proceedings against Mylan relating to the second a medical use patent for Finasteride 1 mg

Representing HTC in patent infringement proceedings initiated by Nokia, which led to a settlement between the parties

Defending OrbusNeich against patent infringement claims relating to its rapid exchange catheter, resulting in revocation of Boston Scientific's patent

Representing Du Pont in the successful defence of the first paediatric SPC extension in the Netherlands

Advising companies in various industries on their trade secret protection regimes

Representing a Honeywell subsidiary in trade secret proceedings leading to the termination of the defendant's business activities

Seizing chemical samples in a Dutch logistical warehouse in absence of a Dutch patent, which evidence was pivotal in securing injunctions for Solvay against Neo in Germany

Obtaining a cross-border injunction covering the Netherlands and Germany shortly after a CJEU decision that was believed to have ended the availability of cross-border relief in Europe
