Jon Talotta focuses his practice on complex litigation and is Chair of the firm's Electronic Information Group, which oversees U.S. and cross-border electronic discovery and information management. Jon has represented U.S. and multinational clients from a variety of industries in U.S. state and federal trial and appellate courts in numerous jurisdictions; arbitrations and mediations, including AAA, ICDR and JAMS proceedings; and state and federal administrative proceedings, including the U.S. Trademark Trial and Appeal Board.
Jon also regularly counsels clients on a range of information risk management issues, including records management, privacy, data security, litigation preparedness, intellectual property and trade secret protection, technology and the Internet, and insurance coverage. He publishes and speaks on topics involving U.S. and international issues affecting civil litigation, electronic discovery, and information risks.
Jon is a Council Member of the Civil Litigation Section of the Virginia Bar Association, and a member of The Sedona Conference (WG1 & WG6) and the American Records Management Association. After law school, he served as a law clerk for The Honorable James C. Cacheris (E.D.Va.). During law school, he served as a law clerk extern for The Honorable B. Waugh Crigler (W.D.Va.).
REPRESENTATIVE EXPERIENCE
- Successful representation of two public real estate investment trusts in state court litigation involving breach of contract and tort claims arising from disputes over a right of first offer relating to commercial property included in $1.3 billion portfolio transaction.
- Successful representation of European distribution company, including recovery of damages and award of declaratory and injunctive relief, following one-week ICDR panel hearing, involving disputes with U.S. manufacturer over breaches of international distribution agreement.
- Successful representation of multinational medical supply company in U.S. federal and state court litigation involving competitor's allegations of trade secret misappropriation, trademark infringement, and unfair business practices.
- Representation of public companies, including from healthcare, financial services, manufacturing and defense industries, in securities class actions and shareholder derivative suits in numerous federal and state courts.
- Representation of clients in proceedings involving alleged violations of state and federal false claims acts, including dismissal of qui tam claims against public company in the U.S. District Court for the Eastern District of Virginia.
- Representation of U.S. and multinational companies in trademark, trade dress, trade secret and copyright disputes in state and federal courts, as well as trademark disputes before the U.S. Trademark Trial and Appeal Board.
- Representation of public and private U.S. and multinational companies in enterprise-wide audits and review of records management, privacy, data security, information management and regulatory compliance, litigation preparedness, and disaster recovery.
- Representation of public and private U.S. and international clients in investigations of fraud and other unlawful online activity, including advance-fee fraud (419 scams), social media website account abuse, online defamation, and software piracy.
- Successful representation of professional association in American Physical Therapy Ass'n v. Federation of State Boards of Physical Therapy, 271 Va. 481, 628 S.E.2d 928 (2006), an appeal involving novel statute of limitations issues.
- Successful representation of international technology company, including oral argument before the Supreme Court of Virginia, in America Online, Inc. v. Nam Tai Electronics, Inc., 264 Va. 583, 571 S.E.2d 128 (2002), a case involving the First Amendment and anonymous Internet speech rights.
