In a recent decision addressing the scope of federal preemption over nuclear safety, the federal district court for Vermont sided squarely with nuclear power plant operator Entergy Nuclear on challenges to state laws that would have forced the early shutdown of its Vermont Yankee plant. The court concluded that the state laws in question were based on nuclear safety concerns and that the Atomic Energy Act gives the U.S. Nuclear Regulatory Commission (NRC) exclusive jurisdiction over issues of nuclear safety.
