Hogan Lovells has wide-ranging environmental litigation experience in both federal and state courts as well as before administrative tribunals. We have successfully handled significant environmental litigation involving all major federal environmental laws, and many state counterparts, including the following:

  • Clean Air Act (CAA)
  • Clean Water Act (CWA)
  • Oil Pollution Act (OPA)
  • Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA)
  • Resource Conservation and Recovery Act (RCRA)
  • Safe Drinking Water Act (SDWA)
  • Toxic Substances Control Act (TSCA)
  • Endangered Species Act (ESA)
  • National Environmental Policy Act (NEPA)
  • Federal Land Policy and Management Act (FLPMA)
  • Atomic Energy Act (AEC)
  • Surface Mining Control and Reclamation Act (SMCRA)

Our environmental litigation lawyers include former U.S. Department of Justice attorneys who prosecuted civil and criminal environmental matters while serving as United States Attorneys, Assistant United States Attorneys, Trial Attorneys, or in other capacities. Our environmental trial lawyers also include the former Director of U.S. Environmental Protection Agency's (EPA) Civil Enforcement Office, and prior to that U.S. EPA’s Air Enforcement Division for the past 10 years was responsible for developing and implementing many of EPA’s regulatory priorities and enforcement initiatives. In addition, our environmental trial and appellate lawyers include the former Acting Solicitor General of the United States, the former General Counsel of the Department of Energy, and a Regent and several Fellows of the American College of Trial Lawyers.

We specialize in representing defendants in individual and mass toxic tort actions where we have applied cutting-edge case management techniques to minimize litigation costs. We are also experienced in working closely with experts in every relevant branch of the medical and natural sciences.

By combining the courtroom capabilities of our nationally recognized trial and appellate litigators with the deep subject-matter expertise of our environmental regulatory lawyers — who have established important legal precedents and have shaped major environmental legal and regulatory policies over the last three decades — Hogan Lovells provides a strong interdisciplinary team to represent clients in complex environmental litigation in the most effective and economical way possible.
