Hogan Lovells' Environment group secured a major victory for Minnkota Power Cooperative in the U.S. District Court for the District of North Dakota on 21 December 2011. Partner Dennis Arfmann has been assisting Minnkota in responding to a U.S. Environmental Protection Agency (EPA) Clean Air Act New Source Review (NSR) enforcement initiative, which the EPA began in 2000. Dennis helped Minnkota settle the NSR case with the EPA and the State of North Dakota in 2006 with an NSR Consent Decree lodged in federal court in North Dakota.
