Jan Christian Eggers focuses on matters of European and German competition and public procurement law. Taking care of various regulatory issues, such as merger control, antitrust investigations, and complex procurement procedures, Jan has helped clients complete projects in a number of industry sectors, including life sciences, medical devices, infrastructure and energy. Jan has extensive experience in procurement disputes before the German and European courts as well as in commercial litigation.

Competition matters on which Jan advises include distribution, cooperation and joint venture arrangements, market dominance issues and compliance. Jan regularly obtains merger control clearances for mergers and acquisitions, and defends clients in antitrust investigations. Increasingly, he gets involved in disputes concerning damages for antitrust infringements.

In the specific field of public procurement, Jan guides clients all the (sometimes long) way from the first steps into a tender procedure, through the preparation of complex bid documents, to the award of a contract. He is experienced in projects in the infrastructure, PPP and healthcare sectors, and has acted for clients in a large number of disputes before the German courts, sometimes including proceedings before the European Court of Justice.

He is based in our Hamburg office and can work in English, German and French. He studied at the universities of Hamburg and Exeter and completed a part of his professional training in Brussels.

Representative experience

Advising Via Gateway Thüringen GmbH & Co. KG on the tender process of the PPP motorway project A9 Thuringia.

Antitrust defence in German cartel investigations in the drugstore products and food sectors.

Representing a satellite communications service provider in procurement litigation concerning a Federal civil defence contract.

Regularly advising various suppliers of medical care products and pharmaceutical companies on tenders by public hospitals and sick funds, including representation in procurement review procedures.
