MLex and Hogan Lovells lunch talk: Foreign Direct Investment Control: Time to act for Europe?

The European Commission has proposed a framework for the screening of foreign direct investments. Does this serve the goal of defending European strategic interests or is it only another sign of new protectionism in global trade? Which role can the EU play in the enforcement of essential national security interests? Which hurdles will companies face when seeking to attract for instance Chinese investors? And how can the proposed rules align with existing control procedures such as merger control?

These are the questions we will be examining in this joint Hogan Lovells-MLex lunchtime talk.

We will be looking at the current legislative process for the proposed EU Regulation and how it will impact national screening procedures. How can Member States and the EU cooperate in a field where the substantive aspects of the review process fall into a domaine reservé of national governments?

We will also explore which industries will be in the spotlight of the new review mechanism and which criteria regularly play a role when authorities decide about foreign investment screenings.

Lastly, we will discuss how companies can prepare for the coordination of merger control and foreign investment control procedures and how this will affect the timelines of international transactions.
