As a counsel focusing on patent litigation, Emma Fulton has worked on cases involving a variety of industry sectors but focusing mainly on life sciences (pharmaceuticals and medical devices) and the electronics sector. Emma's experience includes proceedings in the UK Patents High Court, UK Court of Appeal, the European Patent Office and the CJEU. Much of her practice has a strong international element, with particular experience of coordinated litigation in the UK and Germany.

Emma is currently advising on a patent dispute in the pharmaceutical sector which involves working closely with, and co-ordinating, teams across the UK, Germany, France, Italy, and Spain. Emma also has non-litigious patent experience and has worked on a number of projects evaluating and advising on the strength of pharmaceutical patent portfolios as well as advising on the IP aspects of transactions.

Emma studied law at the University of Cambridge where she also completed an LLM focusing on competition and IP law. Emma completed a Postgraduate Diploma in Intellectual Property Law at the University of Oxford (2010).

Representing a global pharmaceutical company on a case reference to The Court of Justice of the European Union regarding the interpretation of the SPC Regulation.
Advising an international medical devices manufacturer in multiple opposition proceedings in the EPO.
Acting for AGA Medical Corporation in medical device patent litigation against Occlutech (UK) Limited and assisting in parallel litigations in other jurisdictions.
Representing Bristol-Myers Squibb and Merck in obtaining an interim injunction and subsequent final injunction at trial relating to a generic version of an antiretroviral product. [2012] EWHC 627 and [2013] EWHC 1958
Representing HTC in relation to a multijurisdictional patent dispute with Nokia in relation to multiple patents relating to smartphone technology .
Acting for Eli Lilly against Actavis [2014] EWHC 1511 (Pat) and [2015] EWCA Civ 555 in relation to its cancer drug, Pemetrexed.
Acting for AGA Medical Corporation (now part of St Jude Medical) in UK patent litigation proceedings against Occlutech (UK) limited concerning a medical device for the heart. Assisting AGA in its parallel litigations concerning the same patent in other European jurisdictions and before the European Patent Office.
