Dori Ann Hanswirth handles a wide range of civil litigation and focuses on matters affecting the media, with particular attention to copyright, false advertising, trademark, defamation, right of publicity, and invasion of privacy law. Among Dori’s clients are Internet businesses, television networks, film studios, publishing companies, and television and video producers. In addition to her concentration in media, Dori has extensive experience in matters involving trade secrets, unfair competition, product disparagement, employer-employee relations, and commercial litigation.
REPRESENTATIVE EXPERIENCE
- Representation of the United States' highest rated cable news network, including successful litigation against a major media conglomerate to place the network onto cable television systems nationwide, including in New York City, and day-to-day editorial and trademark advice.
- Representation of a trade magazine publisher and television network on a claim of copyright infringement arising out of a photograph depicting a businessman contemplating jumping from a ledge of a building, including winning a motion for summary judgment.
- Successful defense of a cable television network in a trademark infringement litigation, including defeating a motion for a preliminary injunction brought by the publisher of the daily newspaper “Redeye”, which sought to prevent the defendant from airing a cable television program called “Red Eye w/ Greg Gutfeld”.
- Day-to-day representation of a major daily newspaper in New York City, including successful applications for access to court records, governmental information, and court proceedings; many successful litigations defending claims of libel and/or invasion of privacy; and pre-publication and editorial legal review of news articles.
- Representation of a leading commodities exchange asserting claims of theft of trade secrets, breach of contract, and breach of fiduciary duty against a former employee who developed a competing computer program.
- Representation of a large university in action involving claims of breach of contract and copyright infringement against an advertising agency and its principals, in which the firm won a federal jury trial and a federal appeal.
- Representation of a consortium of media organizations on a successful application to unseal records of a guardianship proceeding in which allegations of wrongdoing against sitting judges in Kings County, New York.
- Defense of a major daily newspaper on a claim of libel brought by a judge who was called one of New York's "10 worst judges," including winning on summary judgment and on appeal.
- Representation of a number of software development companies regarding breach of contract claims, including achievement of successful arbitration results.
- Representation of an Internet shopping Web site on a claim of trademark infringement, including winning a motion for summary judgment.
- Defense of a national cable news network against claims of libel and slander brought by the parents and brother of homicide victim JonBenet Ramsey, including winning a motion to dismiss the complaint.
- Defense of a leading hotel chain against claims of copyright infringement.
