REPRESENTATIVE EXPERIENCE
- Representation of Sun Microsystems in multiple patent infringement litigations involving technologies ranging from server technologies, to grid and parallel computing, to object-oriented database applications. Included forcing PAE Exponential to drop its case before pre-trial without any payment or license after favorable Markman and discovery rulings.
- Representation of Daimler/Mercedes Benz in numerous patent infringement litigations in federal district court and the ITC, including those involving embedded communications systems, GPS navigation systems, electronic security, automotive sensors and controls, and supply chain and logistics software. Here too we have on a number of occasions succeeded through strategic approaches to have cases dropped without any payment by our client to a PAE.
- Representation of Dominant Semiconductors before the ITC in a multipatent infringement litigation brought by Osram involving LED technologies. Not only did we defeat infringement claims involving nine patents, but we also avoided an exclusion order on downstream products.
- Representation of Hemcon, Inc. in Federal Circuit appeal against Marine Polymer involving blood clotting bandages. We succeeded in having a $29M verdict and injunction overturned on grounds of claim construction and intervening rights.
- Representation of Lockheed Martin in multiple litigations involving mail sorting devices. We succeeded in having numerous claims dismissed on summary judgment under 28 USC sec. 1498.
- Representation of Eli Lilly in patent infringement action brought by PAE Datatern on multiple patents involving object-oriented database software applications.
